A Customs Union Declaration of Conformity (CU Declaration) is a document of a uniform format that verifies conformity of the products to the requirements of TR CU and is accepted by the manufacturer/contractor (at its own risk). It is one type of mandatory conformity confirmation for the import, sale and use of products in three member countries of the Customs Union (Kazakhstan, Russia and Belarus).

A CU Declaration of Conformity does not require reissue in the form of a national document and is sufficient proof of conformity of the products to the requirements of TR CU for the import, customs clearance and sale of the products specified in the declaration, unless otherwise expressly stated in the Technical Regulations for these products, or unless National Laws on industrial and fire safety apply to them.



What to keep in mind when declaring products


A Declaration of Conformity is prepared by the Applicant, who then applies to the certification body to enter it in the Unified Register (assign a number). All initial information is provided by the Applicant, who is also fully responsible for the accuracy of the information.

However, the actual procedure for completing the document is crucial, since errors and discrepancies in the document are subject to hefty penalties, ranging from payment of a specified amount to confiscation of the goods; and there are always questions and doubts about the correct choice of the declaration scheme, validity periods, the number of technical regulations for the products, completeness of proof the products' conformity to the requirements of TR CU, etc.

WE CARRY OUT THE FULL DECLARATION PROCEDURE

A declarant may be a legal entity (or private entrepreneur) registered in the Customs Union that is the manufacturer or seller (supplier), or acts for a foreign manufacturer under contract with the manufacturer with respect to assuring conformity of the supplied products and responsibility for their conformity to the requirements of the Technical Regulations of the Customs Union.

A Customs Union Declaration may be prepared for either a specific batch of goods or for mass-produced products.

When is a declaration of conformity prepared


The format of a conformity confirmation is specified by the Technical Regulations for the products.

What are the validity periods for a Declaration of Conformity


A Declaration of Conformity is issued for a period of up to five years. No validity period is specified for a Customs Union Declaration for certain types of products.

What is the difference between a certificate and a declaration


A Declaration of Conformity is a document issued by the manufacturer of the goods (by the authorized person) or the importer, in which the quality of the products is declared on the basis of independently collected evidence.

The person submitting the application to the appropriate government agency is responsible for the accuracy of the data.

A Declaration of Conformity is printed on white A4 paper and authenticated with the declarant's signature and stamp.

A Certificate of Conformity is issued by an accredited certification body and confirms the quality of the goods based on tests performed in an accredited laboratory and analysis of the documents by expert auditors qualified to verify their conformity to the specified requirements. A Certificate of Conformity is prepared on a standard form with at least 4 levels of protection. Certification may be either voluntary or mandatory.

Which documents regulate product marking


Requirements for marking products and applying the uniform mark of product circulation on the markets of member countries of the Customs Union are specified in the Technical Regulations for the products. Products included in the Single List of Products are marked in accordance with the laws of the country of destination (Decision No. 620 of the Customs Union Commission of April 7, 2011)
